TradeStar28
Hi....my friends wife was served last Saturday with a summons from a law firm on behalf of Citibank. She owes like 6800 bux, and the debt is legit. It recently went to chargeoff a few months ago. They have the money to pay in full, etc. but just wanted the best route to go to either squash this thing or vacate it before it goes any further. Obviously they dont want to have a default judgement against them.Thanx for help.BTW - they are in NY (friends wife)
chincheck
1) Answer the summons.2) Request debt validation. Even if they know they owe it, they should know how much the lawyers tacked on in fees and interest. Also, the debt could be outside of SOL and can be used as a good defense. I assume you mean the CA (attorney)....i think the tacked on like 1200 in fees and interest. The Debt is def. not outside SOL, btw.Thanx for your prompt response

chincheck
DV is with the attorney. The OC is pretty much a supplier of information at this point. At this point, your friends should start thinking about settlement, and offer it when the time is right. chincheck
You'll probably need to request DV sometime during discovery, but others here can answer whether or not it's ok to send a letter to the atty separately.
