gravelgirl66 Posted May 18, 2005 Report Share Posted May 18, 2005 Hey, I just had a phone call at my job...from A S and Associates regarding a 'check file entity' and if i don't call them back they are going to get my 'employer' involved???I currently am in Ch.7 bankruptcy awaiting discharge, and no creditors showed up at my 341 meeting.... I called back and left a message...not to call me at work anymore...Since I work for a large telecom compay they said " we are going to have to get ____ involved if you don't return our phone call... since it says who I work for on my voicemail...And what does "check file entinty" mean?thanks so much Link to comment Share on other sites More sharing options...
breathing_easier Posted May 18, 2005 Report Share Posted May 18, 2005 I am not familiar with the term "check file entity;" however, perhaps someone else here is.The CA cannot speak to a third party about your account, and even to threaten to do so is a major violation of the FDCPA, let alone following through on that threat. They are just trying to intimidate you, so please don't fall for it. They're counting on that. Since you are in Chapter 7 no doubt your employer is already aware of your financial situation and so the CA's threat has no punch anyway. Also, since you are in Chapter 7 you shouldn't be talking to them. Refer their name and number to your Chapter 7 attorney and have him or her respond to them ASAP. I file my BK pro se...And my employer techinally does know, b/c they were listed as a 'creditor'...I thought maybe like a bounced check or something, but if I was in 'trouble' wouldnt the state Attorney's office be calling me? Or sending me a letter?I guess they are just trying to bully me... if they call back do I need to give them my case #?Or should I just ignore them?
