If a statement shows the last payment made on March 17, 2000 and the due date for the next payment is May 1, 2000, does the SOL period still start 30 days following March 17, 2000 or 30 days from May 1, 2000? Also, does the date of the charge-off have anything to do with the SOL. In this case, the debt was charged off October 31, 2000.Thanks for the help.This site is great!!!! willingtocope Posted May 19, 2005 Report Share Posted May 19, 2005 Since SOL is a state by state thing, you're gonna hafta read through the laws of the state you're in. Usually, its the date on which the account first went delinquent, which usually means the day after the "late" date for the payment you missed...but...State legislators are lawyers too, and they can't resist the urge to tamper. To be safe, tap dance until like June or July before trying to use it as a defense.Or...and you'll have to make this call, since we don't have enough info to advise...you might send the CA a C&D letter saying "even if this is my debt, its beyond the SOL so leave me alone..."
