Hello, I am new to this site. I found it in Feb during the beginning of my journey. It has and is very helpful.

I recently consulted a man who said he could fix my credit. Me and a couple family members went to this meeting set up to discuss his tactics. After a few minutes I determined I could do this, hence the beginning of my credit repair journey.

I started out very successful. I 4 credit cards deleted, 2 doctor bills, and a couple of CA's. My credit score went from 595 to 642. This is great but I have a problem. There are two CAs that refuse to delete the listing on my CR. I have sent the the DV letter, but they failed to respond. Being impatient, after the 30 days I called and ask for a status on my DV. They told me that the 30days would not be up until the 22 of May. Well, I sent the letters certified and they got them on the 18th. So, I informed them of this and they told me ( one of the CA) that they sent this out to me on May 9th (that's a lie), and they said that they could not resend the info because they don't have it. I immediately got mad, and ask for the number to the OC in which the used to verify it. I called the OC and they have no record of my name, SSN, the acct# list on CR, or address. I asked them to send me a copy of a letter on letterhead stating that I never had an account with them. The OC said that they couldn't do this because they had no record. I have just sent both CAs the follow up letters. The CRA won't redispute because they say this is frivilous. My questions are:

Should I send the CRAs a "method of validation" letter?

Has anyone had to deal with Credit Management, Inc and CBSi? If so, how did you get them to remove the listing?

Any other information that you deem helpful will be greatly appreciated

Glad you decided to join the world of credit repair...it's a rewarding, yet sometimes difficult journey. To tell you the truth, there are some CA's and inaccuracies that cannot be removed or fixed without bringing the matter to a courtroom. I just sent an ITS to one of two CA's that won't cave and will be filing in small claims the end of this month if I get no response. The matter is over $25.00 and I'm betting they'll settle if it goes to court since it will cost them more to get a hearing than the debt is worth. Some just like to play hardball.

In regards to your situation, I would send another letter to the CA demanding a resend of the DV as you did not receive it. Unless they can prove by CRRR it was delivered they don't have a leg to stand on. Regardless, they do have to send it or cease collection attempts, which based on opinions from the FTC, includes reporting to the CRA's. Seeing as how the OC is not able to source your records, there's no way a valid DV could have been done. (Of course they don't have it...they never did...he he) Make sure in your letter to dispute the debt entirely...this is important when it comes to the law (FCRA) and also requires the OC to reevaluate the CRA data and correct/remove any unverified or incorrect data.

I would definately request an MOV from the CRA. This may not get you anywhere as the CRA doesn't typically verify with the OC - just a 3rd party (i.e. the CA). Of course they're going to verify it...but you can put in your letter to them that the CA has failed to DV and the item should be removed for failure to validate. Advise the CRA it is against the law to report an unvalidated debt.

I haven't had personal experience with the CA's you're dealing with...but they're all law breaking slimeballs.

I am in the same boat with a $10.00 CA item.

What is your grounds for the suit? -FDCPA violation for failure to DV and FCRA failure to notify CRA's?

Hi, Guys. Thank you for you help. I just got some good news! One of the CAs just informed me that they have sent a letter to the CRA to remove the listing and that they have forwarded me this same letter, they said I should receive this shortly. I hope this is true and not just another tactic. This is the CBSi collection agency. They had two listings on my CR. I have one more too go then my journey is over.
