jgendel
I live in NY and recently I looked at my bank statement to find out some -4k in it. I called, apparently there was a judgement against me and levi on account. I never received any notices of judgment, the last time i heard from the law office that sued was when I sent them a letter a year ago asking for a settlement. Well, I paid them, sent cashiers check by certified mail which they received, but they still haven't released my account and don't return my phone calls. Is anything they did legal? Recovering Attorney
hard to tell. There are lots of papers that have to go out before you get to an execution on a bank account.
jgendel
hard to tell. Because I haven't received a single little thing from them, not even in reply to my letter.
714LEVY
Lots of papers as in, the original lawsuit filed. then they had to serve youw ith papers in some form. once the judgment is filed, im assuming you didnt show up for the court date, they then have the right to come after you for the money ANYWAY THEY CAN GET TO IT.i personally had this done to me too, except they just got about 1000 that wa sin the account- FYI- the account is not frozen, but i WOULDNT USE it until this is resoved. i think the next step is them garnishing your wages.I dont know exactly what transpired with you and the CA and the check you sent, but i would definately get all over this. first off, you need to go to the courts where its filed and request a copy of the whole case. im currently doing this and its a huge mess, keep reading and these forums will help you- BUT YOU HAVE TO GET THIS MOVING ASAP.there may be faults with the suit, such as non proof of service and other loopholes. teh interest will continue to build daily and chances are once its this far, the CA just dont care about negotiations...they have your bank account and want it all, 100% they work on commissions. If they have a levy on your account, they have at least...filed the case, won the judgment, may or may not have requested u to appear for examination, located your bank account and got a qrit of execution from the courts. They then have to take it to the sherriffs/marshall and have it served to your bank location.there has been a ton of paperwork on this already, trust me. youve either, not been available, moved or some reason for you not receiving it. i would check with the courts and find out how they served you.good luck, im just getting started on mine. 714LEVY
also adding, if you did talk to the CA and sent them a settlement and they cashed it.....gawd im hoping you have somethign in writing saying that was acceptable and paid in full if they cashed it, if not- they most likely will just say it was a payment on the debt and a balance remained.
