okie_girl Posted May 24, 2005 Author Report Share Posted May 24, 2005 I denied all the alligations, sorry for the spelling what is summary judgment? there is no court date just a case file, I just sent the answers, to the petition, and one to the court clerk, so I was just wanting to know what is next, I just want to settle this out of court, will they want it all in one lump sum. or could we work out a payment plan I just don't know what is next.okie_girl Link to comment Share on other sites More sharing options...
reverserguru Posted May 24, 2005 Report Share Posted May 24, 2005 What will happen next is they will send you a response to your DV, which will basically be the name of the original creditor and the account number.You can send them a settlement offer at any time. reverserguru Posted May 24, 2005 Report Share Posted May 24, 2005 As far as summary judgment goes, you won't need to wory about that as long as you have denied the allegations in the petition until after they send you discovery (requests for admissions, interrogatories, and request for production of documents).They will request summary judgment (a ruling by the judge given when there are no issues about material fact) if you ignore their requests for admissions.
