Let me clarify some some terms here. Private student loans have a SOL. After the state's SOL has passed they may no longer sue to collect. SOL has nothing to do with ability to collect. ANY creditor may continue trying to collect after the SOL has passed they just can't report to credit reports and can't sue for enforcement.

Actually, they CAN sue for enforcement of the loan. However, it's up to the defendant to bring up the defense of the SOL. If you don't bring it up, the judge won't, and a judgment will be against you.

The SOL is the defense you can use.

...additionally, if you go to court, say...and you don't bring up the SOL as a defense, get a judgment against you, you then don't have a recourse to bring it up to get out of the judgment. It's then too late.
