justamom Posted June 3, 2005 Report Share Posted June 3, 2005 Hello all: I received a letter from a CA because I "charged back" a payment for an item I purchased on line for which I did not receive. The credit card company promptly returned my money however, Bidpay, the co. who I paid to send money to the "fraudulent" seller, has asked me to repay the money. I refused to repay the money explaining to tell them that they allowed a "fraudulent seller" to use their service to collect money - my credit card co. told me that since I didn't get the product, the the credit card returned my money. Now "Western Union" aka Bidpay, has referred me to a CA. A police officer is currently investigating this "fraudulent seller" in Indiana. Do I have any recourse other than pay the money for something I never received to save my excellent credit rating? I've learned here I can ask the CA for 'validation' (and I will do this), but that just may be a temporary delay for further action against me. Thanks for your input. Under the circumstances, state in the letter to the CA that this was a charge for merchandise never received and you don't owe it. If they think they do, have them send you proof. Remind them that since you are disputing, they cannot colelct or report you to teh CRA until they verify. Send the letter by Certified MailComplain to your state AG's consumer frauds division, as well as the Indiana AG. And the FTC. Robert Nashville/Savannah Posted June 6, 2005 Report Share Posted June 6, 2005 As a simple leagl issue, it seems to me you need to know the tearms you agreed to when you retained this company (Bidpay) to handle the transaction - they (Bidpay) may or may not have any responsibility for you receiving or not receiving the merchandise (and they probably don't).If they don't have a legal responsibility for the merchandise, then I would suggest you do owe Bidpay and your real issue is with the fradulent seller.As a practicle matter, however, I doubt this company is going to do anything if you don't pay them other than try to ding your credit, which, as was pointed out, they shouldn't do if you dispute withing the 30days AND they don't validate.
