DV 1st and 2nd letter sent... what next

Hi guys,

I need some instruction on my next steps.

I just finished my first round of DV letters and am waiting on responses from letter #2.

I have collection accounts from:

Midland Credit (credit card)

Credit First Natl (firestone card)

Financial Corp of America (medical bill)

HSBS NV (credit card)

I got my green cards back with signatures dated 5/2 and 5/3. After 30 days with no response, (I am in Texas so the 30 days applies) I sent a 2nd DV letter and have green cards dated 6/3.

They have all verified with the CRA's and have not responded to me, or listed my accounts in dispute. In my 2nd letter I gave them 15 days.

After that, should I send a letter to the CRAs stating that they have not verified or should I just send ITS letters directly to the CAs and see if they delete?

Also, Credit First Natl is listed on my CRA as a collection agency. I DVd them and all they sent me in return was my credit application (which was denied when I applied).. After denial I was added onto my mother's card as an AU and they are denying that fact. They say it was joint. But my credit at the time would not even qualify for joint, as I was in BK.

Anyway, I disputed with them, they told me "too bad so sad" and then I consulted an attorney. (I have prepaid legal so I can do that at no charge). The attorney informed me that the application was not proper validation and she then in turn sent a letter to them stating as such. Basically telling them to either cough up a contract, or something that I signed other than a credit app, or delete, or that she was instructing me to take further legal action. The attorney also included in her letter case law re: Johnson VS MBNA, which is an almost identical case.

They have not responded to that letter either.

Any suggestions?

I have read that it is a NO NO to verify with the CRA before sending you anything to validate.
That is before the 30 days are up. They don't have to validate unless this is within the first 30 days of sending the Dunning Letter. (But they do have to mark your account in dispute, which they did, and cannot continue collection activity.)

Now you know why we don't think very highly of CA's, They seem to have a tendency to lie, cheat and steal.

OK an original Application is not a fully qualified answer to a DV. You've asked for your signature on an applicaiton, and Statements listed the debt and an itemized listed of the debt's charges. All you got was a Signed application. The lack of statements is the key here.

If you were an AU then your name wouldn't be on the statements. You need to find your mother's statements that don't list your name but have the same account number. Then you can go after them asking for more complete DV information. THEN you've got them.

LOL.. Easier said than done. My mother had that debt discharged in her BK 4 years ago. I seriously doubt that she has any paperwork left. she um, ahem, isnt exactly the best record keeper.. lol

But that's a place to start. I will make a visit to her garage..
