Poorgirl Posted June 20, 2005 Report Share Posted June 20, 2005 Discover card is driving me crazy….they have a judgment against me for a credit card debt that was originally around $2,000, now with court cost and their lawyer fees it’s $4,300…I offered to settle with them at $1,000 the only amount of money I could raise at the time; Of course, they refused and demand the full amount be paid. I don’t have $ 4,300 just lying around to pay them off… the collector did offer to let me pay in monthly installments but I don’t want to go this route..I rather pay what I can to settle this once and for all… Also, I’m to appear in court again on yet another judgment they have sent me requesting proof of past income pay check stubs, automobile title ect… The thing is I have not worked in years nor do I at the moment own a car… So, I need advice on what to do? I would be considering BK7, and I would let them know I am considering a BK7 and if they want to see a dime, they'd better figure out a reasonable settlement and fast. What state are you in? Poorgirl Posted June 20, 2005 Author Report Share Posted June 20, 2005 I live in Louisiana...I'm just a poor struggling college student...the debt I have on that old credit card is from me buying food and school books...However, I told them I would file Bk and they became silent on the phone...But then started in on how they'll see me in court crap....I have no other funds...I don't understand why they think that they can get more money from me...when I have zero..I offered them the $1,000 I burrowed from my parents and they turned their nose up at it... Poorgirl Posted June 20, 2005 Author Report Share Posted June 20, 2005 I know that is what they told me as well...The only problem is the money they or hoping to get from me I don't have...So, they getting a Judgment was pointless....But I'm sure legally they needed to get a judgment to see if I had any money or it was just the norm to do those who can't pay...I was also, told by them if I turn in all my financial info before the court date then court date would be canceled...But here is the problem I have no financial info...They must think I'm rich and is hiding money some were... I have no bank records and no job....Should I keep tryn to explain that to them or just forget about it and let them keep ruling me into court until after I finish school and can pay them off with a good paying job... I've found that sometimes the debt is already sold off to a JDB and the JDB will fraudulantly sue on behalf of the Discover. I know someone that has caught a JDB doing this very recently and the JDB will be paying big time. I believe this could also be going on with other OC's as well. I'd suggest bringing proof that you are a full time student......... and explain that you don't have any assets or have a job.Thanks....I'll try bring proof that I'm a full time student to court...Also, the lawyer called me after he received all my financial info...He offered to knock off some of the money he is demanding....I think he only offered that after he checked up on my finanical info and realize I was not joking around when I said I was BROKE the first time.....
