xurlii
I understand that you can sue PER ACTION under the FDCPA and PER VIOLATION under the FCRA. I am not understanding the PER ACTION vs PER VIOLATION idea. What is the difference?
codename_fortyseven
Per action = I violate the FDCPA 10x, you have one time to sue me for the violation. This is why the law isn't followed. Most folks don't know their rights, and even if they do, the most they can get is 1k per violation, unless they have actual damages in excess of that.Per violation = I violate the FCRA 10x, you can have 10x violations in the suit and get 1k PER violation or 10k. xurlii
Thanks Code_ Forty Seven! It is crystal clear to me now.
Been_Ponzied
Today an OC rep actually told me that "it's against the law" for them to delete an item off your credit report if you pay it in full. This is ridiculous, the stuff they get away with. Any Joe off the street would believe them and then stop trying.
xurlii
I totally understand your frustration Been_ Ponzied! What that nit wit told you is a bunch of crap. Where do these "brilliant"CSRs come from? There really needs to be stronger federal regulation against the corruption and unscrupulous acts of many creditors and CAs. Another example of big business bullying the "little guy."

Another example of big business bullying the "little guy." Hi xurlii. So true. It made me so mad that I asked to speak to her supervisor (and of course they put me on hold forever in that passive-aggressive way - I just put them on speakerphone). I told her supervisor that the young lady was dispensing legal advice, and that it is illegal. Good thing I'm retired and bored enough to play with them.
