Collections reported on cr on old debts different agency

Midland Collection agency is reporting a debt which is over 7 years old and is making it appear current. I don't believe that this debt was ever reported negatively to Equifax even though it was reported to Experian. So, if it was never reported to a particular credit agency as negative, can they still report it now even though it is over 7 years old? What do I do? Please Help!!! Also, I have old debts over 7 years old that are being reported on my credit report, however they are not negative, they are still being reported as being paid on time even though they aren't. Can they start reporting negatively at any time?

1-2 punch them as you prepare your federal complaint.

Dispute with Midland, CMRRR and when you get the green card back, dispute with the CRA's.

Get the auto "continued collection" violation and you should have a reaging violation as well when they verify the TL.

If this account was closed/charged off 7+ 180 days ago, they can't report it as paid as agreed. It wasn't, so you have the reporting inaccurate info violation as well.

I'm a little confused. The Midland Collection Agency account is reporting positively on your EQ report? How does the TL read, exactly? Obviously, you don't want any CA reporting on your reports so yes, make it go away.

As to the other old debts that are reporting positively, positive closed accounts are to remain for 10 years from close date per the FCRA, although many will remain for longer. Since age is a good thing when it comes to positive TLs, I don't know why you'd want to remove them. If they were to change to negative, you'd then dispute them off as being past the 7-year + 180-day reporting period for negative accounts.

How do I dispute with Midland? I don't believe I still have the original paperwork from that long ago. What is CMRRR and a green card? How do I file a federal complaint and what is TL?

You say that the debt being reported by Midland is more than 7 years old. Are you referring to the date you opened the account or has it been 7-1/2 years since you first went delinquent on this account ?? It makes a BIG difference.

Collections can NOT survive the obsolescence of the ORIGINAL DEBT, so what is the ORIGINAL creditor's tradline reading ???

You don't have to bait Midland into violating for illegal re-aging ! If this debt went bad more than 7-1/2 years ago, it HAS been re-aged if Midland is reporting any newer date than the date of first delinquency from the ORIGINAL debt.

47, you're beginning to sound like certain parties over on AOC ! Filing a FEDERAL complaint is expensive and time-consuming, and NOT something most people should undertake w/o a lawyer. With the LIMITED information give by the OP, I'd say its a little premature to start yelling about Federal complaints.

Smilee, anything NEGATIVE that is being reported past the legal reporting period you MUST dispute as obsolete. If the trade-lines are positive, which is impossible for a collection account, then it can remain for 10-15 years or more. I've got old positive accounts on my reports that are over 20 years old !

TL = tradeline -- all those entries from creditors and collections are called tradelines.

A FEDERAL complaint is NOT for the legally cluless and it will cost you at LEAST $150 just to file. I hardly think you're anywhere near a Federal suit yet.

CMRRR - certified mail, Return Receipt Requested - you fill out a green card, when the item is delivered and signed for, YOU get the green card back as confirmation of delivery and who signed for it.

Lady,

I am just saying document everything and start looking in the direction of a lawsuit. These folks hardly respond to anything else, and I am a fan of Flyingfir's method over at AOC.

I would NOT fancy the idea of small claims, unless you know the judge is pro-consumer.

Most small claims clerks and judges are idiots anyway. Not a place where I want to handle my grievences.
