carol
Should my daughter send them the validation letter any way ? thanks, carol
LynnInMN
If she really wants to she can ask for a DV. But they have the paperwork...the loan guarany agency gets a copy of the loan docs immediately after she took out the loan. They microfiche it...and by federal standards and regs, they maintain a second database to back up the first one in case of disaster.
carol
Thanks for the information. The first collection agency talked my daughter into taking 50$ a month out of her Husband's checking acct. She then called and said to stop, could not afford it.Then they passed it on to another collection agency. Can she tell them what she could afford? Why did the first collection agency not put a judgment on her? Thanks again, Carol
LynnInMN
Student loans generally do not take out judgements because there is no SOL on collection. They can garnish her wages at anytime without and court order and they can also seize federal and state tax returns.
carol
Thank you.... they did take her tax return maybe two or three times, but that was ok with her. She still owes 4,000. Tax returns were only a few hundred..She did not work the last 14 months. Stay at home mom. When she did work they did not take any money from her pay. Well, at least this is good news, no judgment..It sounds like she should call this new collection agency and make payment's again. thanks for all your help.....Carol
