Verification letters sent to OC's

I sent verification letters to 3 OC's { Capital One, Providian, Speigel} got the green cards back, but never anything from any of the 3 OC's providing verification.

Am I wasting my time?

DOL 03/01 for C1

DOL 05/01 for Prov

DOL 09/01 for SP

The one sure thing about roller coaster rides is that they do end sooner or later.

The problem is that the FACTA ammendments to the FCRA did stipulate that OC should respond to verification requests, but did not include any penalties if they don't...

So...unless there's a good reason for them to respond...they don't.

If these debts are 4 years old or so, are you sure they haven't been charged off and sold?

yes they were charged off and sold, or at least that is what the TL said, now they are not reporting that anymore, they just keep changing the TL and making my score crazy..

If when I disputed the TL and it came back verified as being reported correctly, can they keep changing it like that, when they kept verifying it was right? They changed it 2 times in 1 month, then changed it again the next month.

If they have indeed sold these accounts to a JDB, then the OC isn't going to be much help. Your only recourse with them is to be sure that it is reported accurately...i.e., ACCOUNT STATUS="charge off / sold to another lender", ACCOUNT BALANCE = $0. If they're reporting anything else (except of course for "In dispute") then you might send them an ITS letter for violations of the FCRA (reporting incorrect data).

Are there any JDB's reporting these?

No, I only had one JDB and I dv'd them and they didnt have anything so they removed the TL..

On Speigel, it shows DOL as 09/01 but on payment history it show CO as of 08/03

on Prov. it shows DOL as 05/01 but payment history shows not charge off until 05/05

crap 1 shoes DOL as 03/01 but pymt history shows CO as of Feb 02

Its the DOL that you need to go by...the CO date doesn't really matter.

You need to check the SOL for your state...its possible these debts are uncollectable. That doesn't mean that someone won't try or that you can get them removed from your CRs, but if you were to be sued you'd have an absolute defense.
