birdiedog
I received a summons and have filed an answer with the courts denying the claim. Should I send another dv cmrrr to the CA requesting statements with last purchases, proof of their license, proof of last payment? This CA has been reporting pymts 120 days late every 6 mo to keep my score down when a payment has never been made. Is that a violation?
c m chase
I think sending a DV now would be useless. Work on your case. You have violations already...you might have more. They're reporting on your report....have you ever disputed?Did you ever send anything (DV or otherwise) to this CA? What about the lawfirm? What letters do you have?Mods...could we move this to the lawyer section?
KentWA
To get the documents you are seeking you need to pursue Discovery as part of the case. You need to also file counter claims. Those can be used to offset any award they may get, or even exceed the amount they are seeking. They can also work as great leverage if you are just looking to get them to dismiss the whole thing. Recovering Attorney
Did you send a copy of your answer to the plaintiff's lawyers? If not, do so now. As Kent says, you may want to amend your answer to include some affirmative defenses and counterclaims. Read along here.

My last dispute stated that I did not pay in june of 04, nor Dec of 04, therefore I am not 120 days past due (which the CA does to keep my score down).
