SOL Question

Silly, naive me....

I have a rental house. I felt really bad for the renters as they couldn't get the electric hooked up right away because it required a deposit. I left it in my name so they could have a little time to borrow the money from family to turn it over to their names.

I received a bill, talked to them and they paid it (July, 2002). I received another bill, called them... they said they'd take care of it. Recieved another bill, called them... they said they already took care of it. We then transferred overseas, I never heard another peep about it until we tried to buy a car and I had a collection agency (FMS, Inc) entry on my profile on behalf of the electric company.

I contacted the BBB and they did provide proof to the BBB that the account was mine.

My question is... when does the SOL clock start ticking for a utility bill? The last payment made to the electric company was 7, 2002.

The SOL for a written contract in Oklahoma is 5 years.

However, because it's a utility bill, the state UCC may apply rather than the Oklahome State Statutes. If so, the SOL could be different. You will need to do some research.

Also, you mention going overseas. Depending on your situation, you may have tolled the SOL (stopped the clock), if you were out of the country and unavailable for collection activities. Once again, further research is probably called for on your part. Good luck to you.
