The big question mark was her car -- 1999 Mazda protege that was paid off. She is on social security and only getting $800/month. The trustee even attested to the fact that $800 is not much to survive on, especially with prescription. Then, he turned around and valued the car at $4000 (with almost 100k miles, the Mazda dealer appraised it about $2000) and as it needed some work done, he cut that figure to $1500. Now, my Mom has to make payments within the next 6 months to pay this off. I am thoroughly disgusted--what is the point of this?? The exemption in Florida is $1000--it's a 6 year old car in okay condition. Will someone explain this to me??One last question...I know there is some verbiage about receiving money before the discharge of bk...can someone enlighten me?Thanks! She's over the exemption that is set by state law. Nothing the trustee can do about it.If she receives money from an estate, lawsuit or, divorce settlement within 180 days of filing, she must report that to the trustee. rockygirl Posted July 30, 2005 Report Share Posted July 30, 2005 I thought flordia was like Texas, your home (up to $125 k now with new laws) and car (1 per driver) is not included in your assests? LadynRed Posted July 31, 2005 Report Share Posted July 31, 2005 FL does NOT exempt 1 car per licensed driver like TX. FL has a flat $1,000 exemption for a vehicle for each filer, that's IT.
