CAresponded to my DV request with another collections letter

The CA received my DV request July 15th - I know they did even though they didn't send back the green card (nasty little snots they are!) because I tracked receipt on the USPS website.

Their response to this was a collections letter dated August 1st demanding payment and threatening "further collection activity" since it appeared I didn't plan to satsify the debt voluntarily.

Can anyone help with a really good response to this? I had planned on sending a copy of the DV letter I already sent them and including a copy of the delivery receipt for their reading pleasure.

I can't recall the date on the original collections notice but I don't think my letter arrived to their office before the first 30 days was up. Can they still pursue collection activity without validating if it was outside the 30 days?

How about a summons for continued collection activity, threats of action they can't legally take (ie. future collection activity), false or misleading representation.

You guys really love sending letters, but you only need to send one to assert your rights. If they aren't respecting your rights, sue them.

Sounds like you have everything documented, I'd be looking for a naca.net lawyer.

Okay, I am going to call them onto the carpet for this. I'm going onto naca.net and am going to hunt for a lawyer to help me sue them.

I was worried that I wouldn't have a case because I missed the 30-day DV window where they assume the debt is valid, but they now have my DV and are still attempting to collect. :roll: I'm going after them!
