Car Accident, How do I get paperwork showing balance paid ?

Hello All,

Havent been posting in a while, I have come on from time to time and read others posts, I actually get some emails about my scores and help because I got that jump in a year...I take that as a compliment.

But I still have my worst baddy on my report, a car loan I had was "paid off" by an insurance that was attached to my loan to protect their investment, they said I owed $249 and now have numerous 120+ day lates and a charge-off balance owing $1,100. I tried to speak with the lady and just pay for a delete because I had the money, she refused the deletion. So now I would like to get the paperwork showing the itemized payments on my loan and the amount payed after the accident. Is there any way for me to get this paperwork? I have disputed 3 times with the CRA's, always verified, but have not sent DV letter to OC, I am assuming because of my conversations with them they will not send me anyting. What would you doi to get this paperwork, the reason I am trying to get this is because I remember back in the day recieving a letter stating I still owed $1100 and this was immediately after the accident. But when I called a couple months ago (4 years later), she said I owe $250, but $1,100 total because of fees. This doenst make any sense and I believe they doctored the materials and I want them...Can an American get some JUSTICE up in HERE!! :D

I believe this debt is past the SOL since SOL is four years in CA for all contracts except oral, which is two years. So at least you don't have to worry about that.

Are you sure you're dealing with the OC and not a CA? Just checking, because of course you know if it's a CA then you'd need to DV them.

From your conversation with the insurance company/OC it doesn't sound as if you asked for an itemized breakdown of the account. I can't see why they would object to giving you a breakdown if you were to ask. However, keep in mind that it might prompt them to resume collection activity (even though they're probably past the SOL). If your only reason for wanting the breakdown is to get them off your reports, you might want to just leave the TL alone and wait until it drops off in a few years. Are there inaccuracies in the TL (in addition to the $1100 balance) that you can dispute? If there are and the OC has verifyied them, then you might want to think about suing for FCRA violations to make the TL disappear.

Yeah it is definately the OC, they have never turned it over to anyone else, I actually called right after 4 years had passed and when I told the lady I would be willing to make payment for a deletion she said no way and I said well then I will just use the courts, she said well whats you address now I will have you served tomorrow, and I laughed at her and said you cant sue me, it is past the SOL in california. Of course she said no its not and I just laughed again and left it at that. I only callled because every single attempt of disputes of course came back verified and I could get nowhere so I tried a method that worked on a couple of collections I got payed and delelted. So do they have to send me an Itemized statement? I would like it on hand.

In other bad news, I had a Collection I got a investigation and deletion on last year, for some reason the company just send me another letter demanding payment, this is a 6 year old debt, but I didnt get a letter from Equifax stating it was being re-inserted, do you know how soliid my case is to force a delete and get paid for this violation. And also, the CA is Crying legal means to make me pay this debt, and it is clearly out of SOL for Civil action, did I read the FCRA right that this is a violation because they are using tactics that are not enforceable??

Equifax actually did this with 2 collections, this other colllection I successfully got the delete on the dispute, but then the CA moved it to TU, that was about 6 months ago, now it is on all three, I sent a DV letter to the CA and I have the CMRR confirmed delivery and they did not mark it in dispute and then decided to send report it on all 3. But like I said, with this Collection and the one I referenced above were re-inserted and I received no letter from Equifax.

Man I was down to 2 Collections showing on TU, ZERO on EX and the CAR loan one on Equifax, now I have 2 on all 3. Back to the drawing board...My scores are now all at about 650, so there wasnt a big drop in scores but of course if I apply for credit now any prime lender will decline me automatically because of the CO. :evil:
