Mobob Posted August 14, 2005 Report Share Posted August 14, 2005 In Sept. 2001 I visited a hospital emergency room. I had full insurance converage. The doctor's bill was never sent to my insurance co. Why, I don't know. I was first notified by a debt collection agency in May of 2005 that I owed $602 and pay up or else. I have a letter from my insurance company stating they first received the claim for payment of this Sept. 2001 bill in June,2005. Actually, it was the insurance co. rep who contacted the debt collection agency and retrieved this claim for payment. The insurance co. just sent me a check to forward to the debt collection agency for $275, the amount the doctor would have received had he submitted a claim for payment in 2001. Should I expect the credit collection agency to come after me for the difference between $602 and $275. The insurance co. letter says I never owed this bill, it was covered by my insurance. Who pays for the failure by the doctor or whomever to apply for payment of the claim in 2001? I am told the debt collection agency who contacted me is a real bottom feeder, so I don't know what to expect. I have spent the last 2 months trying to repair my credit which the debt collection agency damaged in 2003 without my knowledge. Can they damage me again if I don't pay the difference between the $205 and the $602? This whole event has been a real eye opener. I realize how ignorant I have been about checking my credit bureau reports, and how easy it is for a ceditor to damage my credit score whether the bill is legitimate or not. codename_fortyseven Posted August 14, 2005 Report Share Posted August 14, 2005 Just for grins, I would send a DV. It isn't up for you to figure out the difference of this bill or were that came from. The CA has to produce that. The CA may try to come after you for the difference, but I would DV them and see what happens. They need to produce a full accounting of the debt, an agreement showing at what rate the interest can accrue, etc...They need to document where that other 300 and change came from and show that you signed something saying you would pay it. I wouldn't ask for this, I would just DV and let the CA likely surprise you with a multitude of violations.It isn't your fault the doc didn't send the bill.
