Is Someone Trying To Serve Papers On Me?

Hey all. This is my first time posting here so I'm sorry if it's too long.

Anyway, I had the strangest thing happen to me the other night around 8:30pm. A person rang my intercom but didn't answer when my husband asked "Who Is It." Obviously my husband did not let the person into the lobby.

About 10 minutes later, the person rang the doorbell to our apartment. I don't know how the person got through the downstairs door but, he got through. My husband asked again "Who Is It?" The guy didn't give a name but proceeded to ask for me. My husband said "She's not here" and the guy asked "Are you her brother?" My husband said no. My husband said the guy was wearing some T-shirt that said "Harlem" on the front with lots of graffiti on it. The guy also appeared young, perhaps in his mid to late 20's.

The guy then said "Could you take this package for her?" My husband said no and, at that point, I stepped in front of the peep hole to see who was at the door. All I could see was some guy waiving what appeared to be a fake badge at the peep hole. Finally, my husband said that I don't live there and told the man to get away from his door.

I thought that, perhaps, the guy was a process server but wouldn't a server say that he/she is there to serve papers or something? I'm currently involved with a few bank disputes but those banks collectors have sent letters to me saying that they will not proceed and collect until they verify the debt as per the Fair Debt Collection Practices Act. I know some collectors are shady, however, and will pull hardball tactics like this.

Accordingly, I called the New York State Supreme Court (NY's trial court) for my county and the US District Court for my county the next day to see if someone has filed a lawsuit against me. Both the State and the Federal Court said that no lawsuits are pending against me.

The only other explanation for this could be an old boyfriend that has a serious grudge against me. One of my old boyfriends called me on the fly about 6 weeks ago looking for a date. I told him not to call me anymore because I'm now married and my husband lives with me. I haven't heard from this guy in about 1 year. In any event, this guy became very angry with me and seemed very scorned to say the least. This guy is also a former bouncer, is currently a black belt, and was trying out for the CIA last year, so it's possible he's an officer now.

So am I being sued, harassed, or both? I really hope it's not a debt collector trying some shady tactics but, if so, should I place my money in another bank account? I heard some collectors will forge process papers, get a default judgment against you, and then place a hold on your bank account. Please advise.

Wow...you sure do have enough stuff going on that its really hard to tell who's coming at you. The only way you'll know for sure is to answer the door. (I'm guessing it probably isn't a process server...but you need to check the rules of service for your state. Most states allow mail or "nail it to the door" type service, so the guy wouldn't have to be so persistent)

Exactly and, yes, I did check the rules for New York and there are about 3 other ways to serve process besides personal service, including "nail (leave) and mail and certified mail." The Civil Rules also say that, first, the plaintiff must file the summons and the complaint with the court clerk and purchase an index number before serving a copy of the summons and complaint on the defendant (me). Since neither the state trial court nor the federal district court for my county has a record of any lawsuits pending against me, this leads me to believe that either this was a hardball tactic from a creditor, the creditor filed suit in the wrong court (consumer credit actions should be filed in the county where the debtor resides), or a disgruntled ex is out to get me. :cry:

However, I'm more concerned about some slimeball bill collector getting a default judgment against me without properly serving me, then placing a hold on my bank account. This is why I'm thinking about transferring my money into another bank account. I wish I knew the right thing to do in this situation.

How do you "try out" for the CIA?? It's not like it is a football team. The guy sounds like a crack pot Rambo wannabe. The CIA hires college graduates and career upper level military personel. The fact that he was a former bouncer indicates he is neither. I think he has seen too many episodes of "24". As for him having a blackbelt, he seems to have one in hooking up with naive women. I wonder if the guy at your door could have been some kind of private investigator? His method for tracking people down would be far from suttle, but who knows, most PI's are guys like yor ex-boyfriend anyway.
