cavazos007
Okay I have 14 charge off accounts I just sent out my DV letters. But I noticed on my credit report that some of my charge offs are still under the OC name. Should I send a DV on those charge offs? The OC never transfrd them to a CA. Any suggestions? Been_Ponzied
You really have your work cut out for you! I've read here that, although it says in the new FACTA law that you can DV the OC, they are under no obligation to validate. Good luck
cavazos007
So I should just DV the CA right? The OC accounts are about 3 to 4 years old. My SOL is 4 years.

Well, you can DV the CA if you want, but if you are that close to SOL, then I would just wait it out. I haven't gotten anything removed yet by DV'ing anyway. But that's just me. bbcardfan
I have that same issue. I live in cali w/the 4 year SOL. I have the following sample notationsCitibank- charged off on XYZMidland- references that same Citibank debtHousehold- charged off on XYZMidland- references that same household debtThe 7.5 yr dinging period expires on 8/10 of my ccs in 2006-2007, and the 4 year calif SOL has already run, so I am looking to see how I can get midland (who did not appear until AFTER the SOL had expired) off my report. cavazos007
So when the SOL expires when it reaches my 4 years what do I do?
bbcardfan
I waited until the SOL expired. I read that some people have then written cease and desist letters to collection agencies saying to stop collecting b/c the SOL has expired. However, I have not tried that/am not sure that will remove the negatives on your credit report for the collection agencies.Look under the 'debt validation' forum...they seem to have some good tips about SOLs
Northern Lights
Did you try writing a letter to the credit bureaus disputing the accounts as not mine. You may just get lucky and have a few removed if they fail to respond. Then I would wait and send off another round as not mine and you may be suprised of the results. I had several accounts removed by just disputing with the credit bureaus first.
cavazos007
Yes I did that and a few fell off. Now I'm trying plan B.
Been_Ponzied
After the SOL's have expired, why don't you just check your credit files and if they are still there, call the Credit Bureaus and tell them the SOL expired? I don't see how they could think twice about removing something like that. But you'd have to be sure the SOL is over.

They can report it whenever they'd like as a matter of record.IMO, the OP ought to use the executive level of the OC's company to remove the TL, and the DV & dispute processes vs. the CA's.
