Out of SOL - Whats my next step??

First and Foremost, this forum is AWESOME. I came to know a lot about my rights, privelges and what not.

Now let me share my little succes so far and ask you my next step.

1. I opted out

2. I got my old/inaccurate information purged from all the CRAs

3. I ordered paper copies of my CR and now for sure know that almost all the accounts are out of SOL

Whats my next step now? Can I just write letters to all collection agencies that since SOL is over, it is unlawful to try collecting the moneys? Or dispute all my accounts as Not Mine with CRAs?

How can get the OCs off my back? Can I try to settle with them for a PFD??

Some one please advise me.

How far away are you from the reporting SOL

I dont understand your question. :oops: All these accounts have a four year SOL ( TX ). The Date of Last Activity is between 03/01 and 12/01.

Does your OC TL say transferred/sold

All the OCs say "Charged Off"

To answer your question, the SOL applies to legal action a creditor can take against you, if it is 4 years in your state (TX) then you do not have to worry about them filing a suit against, or if they do you a have SOL defense. As far as reporting on the CBR goes that is a seperate time frame which is 7 years from date of last activity. I hope that clears up some of your confusion

Thanks skippy for answering my other questions.

My real question is where do I go from here now that I know that I am out of SOL for many of these collections. I do want to get rid of all baddies as I plan to buy a house some time next year.

I would start with disputing the accounts with the Credit Bureaus, use whichever dispute you feel comfortable with.. Not yours, Incorrect info, etc.

If there are collection agencies contacting you about these accounts, send them a cease and desist, so you do not have to bother with them. Be advised them may just send it off to another agency, but be vigilent with the cease and desist to any agency that sends you a request for payment.

I would try to avoid the "not mine" dispute for all the accounts. You may end up causing a fraud alert to be placed on your file. This is the reason I was asking how far away are you from the reporting SOL. If the OC is not currently updating you stand a better chance of getting the TL deleted. Also if the TL says transferred/sold even better. OC is rid of the debt anyway and would probably not answer your dispute. For example, if the OC last reported last month, most likely they will verify the TL. If the OC last updated two years ago, they don't want to be bothered anyway, so most likely a deletion for you. If you are close to the 7 year reporting SOL, disputing as obsolete might be the better way to go if the reporting period ends in 6-9 months from now.

For the CA/JDB TL, if they are reporting. Dispute, things like the status date, date opened, high balance, amount owed etc. This makes both the CRA and the CA/JDB work to get the TL verifed. Thus making it easier for you to get the deletion. Most times they don't want to be bothered verifying all that info.

These methods should take care of the reporting on your CR. As far as CA/JDB, you could send them a cease and dissist if they are still contacting you about paying.

Thanks a lot every one for the help.

Here is what I plan to do.

1. Try disputing the debts with CRAs where OC is not reporting, but CAs are. Do the same where OC is very dormant

2. DV the remaining collections for inaccurate information.

But how about the OCs which are still reporting? I believe I cannot DV the OCs. How can I go about getting rid of these off my CR??
