:?:Need help with Language in Motion/Declaration to Vacate

Recommended Posts

A default judgment was entered against me on 10/26. I need to petition the court to vacate the default judgment. I'm studying the "How To" material on this site, but I'm confused by the following language:

MOTION AND DECLARATION TO VACATE JUDGMENT

"NOW COMES the Plaintiff, Pro Se and prays this Honorable Court to Deny the Defendant's Motion to Dismiss and Motion for Sanction for the following reasons:"

Is this statement correct? To my reasoning it should be:

NOW COMES the defendant (me).......to Deny the Plaintiff's (handyman/crook suing me) Motion to Dismiss and Motion for Sanction.......

It's just not making sense to me the way it's written. Seems like plaintiff and defendant should be reversed. Can someone tell me if I'm not interpreting this correctly and set me straight on this one? Thanks.

This would be a new case, and since you would be the one bringing the petiton before the court, you would be the plaintiff. Roles are reversed now.

I know doesn't make a lot of sense. You're basically suing the person who sued to have the previous lawsuit go bye-bye.
