censorme Posted January 10, 2006 Report Share Posted January 10, 2006 Like many people, I'm being sued by Wolpoff & Abramson on behalf of Palisades Collection. It is a limited civil case in San Diego county California, for $5400.00 from a Providian Credit Card. The debt is more then 3 years old, so I'm guessing they are trying to beat the statute of limitations. Wolpoff & Abramson have been calling my parents house for months, literally everyday with a recorded message. Sometimes a real person would call and try to fool my parents into thinking they were a freind of mine. I recieved the court papers 4 days before Christmas, which I believe was to limit the amount of time I have to file my response and make it more likely they would recieve a default judgement. The papers were served to my parent's neighbor as an open packet in plain view. I haven't lived with my parents for several years.What I have a problem with is that these guys have sent me letters with several different amounts that I supposedly owe them. I never responded to them because I was unsure of how to verify that the amount they claimed I owed them was legit and that the company itself was on the level. Basiclly I'd like to know if would be worth getting a lawyer. Can I still request debt validation? I didn't receive an interrogatory. If so, then serving the papers at your parents house is a deliberate attempt to get an easy win and serving your parents NEIGHBOR utterly ridiculous ! I never responded to them because I was unsure of how to verify that the amount they claimed I owed them was legit and that the company itself was on the level.You SHOULD have responded with a request for validation - now its pretty much too late and you're going to have to challenge the validity and the facts of the debt in court. W&A are total scumbags, but they are a legit company.If you are required to file an Answer to the Complaint do so by the due date. In addition, you can send a SEPARATE validation letter to the attorney that's suing for W&A.If you're not comfortable handling this on your own, by all means hire a lawyer. They did exactly the same thing - served my parents house. The court said my dad wrote "return to sender" on the paperwork and sent it back, and then they left a notice on their door. Got a default judgment as I didn't realize I even had a friggin court date. They just sent a letter to my real address - my apartment - is that proof they knew my legal address? I think I will hire an attorney because of time constraints. If you or anyone can recommend an attorney in Southern California, preferably in Orange County, I would greatly appreciate it.
