sizax Posted January 12, 2006 Report Share Posted January 12, 2006 So here is what happened:Over the last week i kept getting missed calls from a number out of Iowa, well not thinking that i have any new collections in the works I called it to find out who they are. Come to find out they are CBE Group collecting a debt from dish network. I told the guy, lets call him "Berry", that I have yet to recieve any sort of correspondence from them even suggesting this account is in collections, as I just recieved a final bill from Dish Network 12/26/05 (I transferred to DirectTV) Berry told me they sent out a letter on 1/6/06. I told him that I would not aggree to pay anything until I recieved a letter from them stating they are authorized to collect this debt so He might want to send out another one. He told me that they wont be doing that. I then asked him for an address so that I can send them a letter of Validation. He was baffled by that and seem to not know what I was talking about, after he put me on hold for a couple minutes he gave it to me (I think he was seeking advise of a peer) He told me that he could stop the calls from coming in for 10 days. I told him that is fine, but from this point out Not to call me at all, he needs to cease and desist. He said that he could only stop the calls for 10 days. I said thats fine but according to the FDCRA he is not allowed to call anymore at all because of my request. I told him I will of course follow up with a letter that he should be recieving well before the 10 days end. He told me obviously I didnt know the law and I have no such rights. I told him politly, thank you for your time and I hung up. This could be fun. I of course have every intention of paying the bill, directly to dish network of course. as it is mine and Ive done a bang up job getting things deleted and dont want to play this game anymore. ghacorp Posted January 12, 2006 Report Share Posted January 12, 2006 Send a DV letter and require they communicate with you in writing only. Be sure to send the letter via Certified Mail to make sure you can prove they received it. Some of the smaller collection agencies apparently don't school their employees on FTC laws.
