attorney for iib says not his problem

I sent a letter to the OC of an acct iib Discharged in 2004 and still being reported as an open collection. The OC also sold the account to another CA so it appears twice on my CR. My letter told them that they were in violation of FEderal law and this was a "form of collection activity" and demanded they removed their tradeline. I recieved a letter from an attorney who wrote back and told me that their records show it as being iib and if I believe that there are any discrepancies with this account I will need to request an investigation thru the CB. He went on to say that he has complied with all state and federal saws including 11 U.S.C.362 with regards to the reporting of the tradeline.

My embryonic knowledge of this is that as the OC they are required to report it correctly or remove it. Any help on this is appreciated. What do I do next?

First of all...make sure you're looking at a recent copy of the original CRA report...not one of those 3-in-1 reports (they do tend to be inaccurate and out of date).

If it is indeed on the original CR, then a "dispute" letter to them is in order. Make sure you send it CMRRR and tell them to investigate. If it comes back "verified", then follow it up with an ITS letter to both the OC and the CRA.
