We lost our Summary Judgment motion.

Recommended Posts

Well, after a year we lost our case in Summary Judgment. But I'm not angry. We put up a good fight. We didn't turn over and let them get a default judgment. We learned alot along the way, and we will continue to help those fight their cases. This was a longshot from the start. It wasn't a JDB suing us, it was the original creditor. They had nothing but statements for evidence, but that's all they needed. They didn't have anything with your signature. What have we learned from all this? Credit cards are the devil! LOL But seriously, credit cards are an enticement to spend money you don't have, but with the rediculous late fees, overlimit fees, bounce check fees, high interests, you will always lose unless you payoff your balance each month! Now, we only have one with a $500 credit limit that we pay off each month. Good luck to all who fight! We went down after a good fight, but we're still standing!

Good for you for exercising your rights on this!

The idea (contrary to some popular belief) is not to find a loophole to get out of paying, but not to just roll over - exactly what you did not do. So... kudos to you.

They had nothing but statements for evidence, but that's all they needed. They didn't have anything with your signature.

This is very key. Information is still being passed around that they need something with a signature - that is simply not the case.
