I need help nailing an inquiry giving me the run around!!

I have been wrinting Kroll Factual Data about an unauthorized Inquiry and the only thing they have said is that I am supposed to send them my info that they are already supposed to have being that I am not in thier system, also they said the MAYBE have spelled my name wrong. Anyways, I refused to give them anything and told them to remove it or be sued. HOWEVER, looking at the FCRA, I noticed under 623 (8)(D) it staes that I have to give them all the info needed to investigate, and or required by the furnisher to substanciate the basis of the dispute. So can I even sue them or threaten to do so if I refuse to give them my SSN, and all things involved in my credit report? Thanks lindsay

Have you applied for a job recently or perhaps filled out a rental or loan application? These guys do pre-employment background checksm, all sorts of stuff.

Could you have given permission w/o realizing it? Did they do a hard or soft pull?

The furnisher can claim that an investigation couldn't be initiated since you didn't provide them w/ the information "they need" to start the investigation. But that aside, first of all...you can't even sue them unless you dispute w/ the CRAs first. Have you tried that? For EQ, disputing an inquiry is a breeze. You'll have to go thru the fraud depts @ EX & TU to have the inquiry investigated.

oh no I have been disputing the inquiries with the CRA's since JAN. The only thing I get back from them is "by federal law, your personal credit report must list all organizations that have requested your credit history" Blah Blah Blah..... thats all I have gotton back from them. I just dont think they are investigating them. I have contacted the inquiries myself and gotton a few that said the same thing .... they need more info on me to investigate and do not find me in thier file. And some that say just we dont have you on file, so I have sent a copy of the letters to the CRAs to have them removed. Thanks

Do you have a fraud alert on your file? How did you dispute w/ the CRAs? I REALLY can't see EQ giving anyone a hard time about inquiries. If they do, just hang up & call right back. I just had 6 inquiries deleted from EX 2 months ago. Since I have a FA on my credit file, it was no hassle for me to be transferred to the fraud dept. They asked me a couple of questions, including if I thought that the inquiry was due to fraud. Of course I said "yes" and they were under investigation for about 3wks. Considering the inquiry was not authorized by you, I really can't understand why you're having such a hard time.

If you've exhausted all of your options, then the only way you're going to get this removed is thru a lawsuit. Don't threaten to sue them unless you actually intend to. But I would most definitely try disputing again w/ the CRAs or giving Kroll Factual Data the information they requested (if having the inquiry removed is your true goal).

I would give them the info, unless you really don't care about the inquiry. The idea about claiming a fraud alert is a good one.

I had an old mortgage broker pull my CR through Credco, principally as a sales prospect. I threatened to to sue them both. The borker settled immediately. CREDCO balked, so I sued them. Kroll will claim, as CREDCO does, that they ge tthe protection of the CRA. But I don't believe that is right. So, in your writing to them, ask WHO Kroll pulled the reports for. Someone had to give them your name and info.

Well I found who the origional person is and I wrote them a letter today thinking maybe that would help.

Also, I have put a fraud alert on my file beacause there are like 5 or 6 mortgage comapny pulls in like one or 2 months. Like I said I think someone pulled my credit a bunch of times either as spite or mistake. (We had problems with an :<img src=:'> EX of my husbands shes nuts) I think thats what she was doing. I cant prove it, but that is what has led me to trying these inquiries. Thanks for all the advice you guys are AWESOME I love this site!!! ::ImInLove::

Thank you so much for the info ... I just found out Kroll is not even on ANY of my 3 CRAs anymore sooo screw 'em. I have successfully removes about 14 inquiries off of just ONE CREDIT REPORT!!! I am extatic!!! I will keep looking into ways to prove that freak did this but I dont think it matters now all the inquiries she put on there are all GONE!! Thanks again for all the help and hopefully someone with the same question can get some info from this. Sometimes the FCRA can be a little confusing... Thanks Lindsay

We have a friend who is a money guy w/ Remax. He was checking to see where we stand with getting a mortgage and the inquiries were listed as Kroll Factual Data....I think the lender is National City Mortgage...
