Aerovette
The CA says DOLA is 2003 and I am certain it is not, BUT, Transunion does not show DOLA. The OC will not tell me (They say they do not have the information because the account was sold to Atlantic). Atlantic has sold the debt to someone else and it is CA number 5 that has it and I don't trust the date they are giving me. Their credit pull was from TU. I know this because of the inquiry. How can I find out the REAL DOLA?
hinky
On Tu, they always list it as "Date this item will be removed" etc. If it says 10/2008, then it would mean that the DOLA was 10/2001. Does that help? See if that adds up to soemthing different than what they've told you.
Aerovette
When I went to the TU site and looked at a "sample" report, it was JUST LIKE my TrueCredit report and it did not show a removal date. It showed the date opened and date reported. I KNOW the date reported is not it because it matches the last COL date in the graph.
hinky
Next step I think would be to call the bureaus and see for sure what they have. If they refuse to validate, you might have to take them to court to find out. The judge probably won't appreciate them very much for that... tufftub
Just one problem I see though -- you can't always trust that what a CRA has as the DOLA is correct.

I want a date that will hold up in court. The timeline is critical. SOL is approaching.

Disregard the sample one.The date on your CR can be held up in court, if it's the best you have. Considering the OC has sold it and the JDB won't validate, your CR will have to do. Is it only reporting on TU? If so, then you'll need to pull your actual report from TU.
Aerovette
Earthangel, I pulled my REAL TU and it says "estimated to drop off 6/2009" So subtracting 3 years from that (TX SOL is 4 years) takes me to 6/06. Now I need to ADD BACK the 180 days (I heard SOL starts 180 days AFTER the first missed payment). From that I get 12/06. Is that correct? (I posted this question just a minute ago, oops.) (I posted this question just a minute ago, oops.)SOL starts as soon as you go delinquent (miss a payment). So, the SOL (according to your TU report...which is supposed to be accurate per the FCRA, riiight ) would've expired 6/06.
Aerovette
It is VERY critical that I get final determination on the 180 day issue BECAUSE, I am in the process of DV and will more than likely be sued. IF and it is a BIG IF, IF the 180 days PLUS the last missed payment is NOT true, then they cannot collect at all. Where can I get final and absolute determination on the 180 days? I found out about it through other posts.
