Next Step Disputing against OC

Hey everyone,

I must have made someone mad out there because I can't seem to get an answer to my question regarding a dispute with an OC. If I did, I sincerely apologize because it seems like I have become a leper on the board.

I disputed twice an AMX account with all three CRA's, online and then via CMRRR and they all returned verified. After that I sent AMX a CMRRR dispute letter stating that I had disputed the account with all three CRA's and am now disputing the account with AMX directly citing the specific FACTA laws allowing me to dispute directly with the OC and requesting the records that they used to verify the dispute with the CRA's. They never responded with either the 5 day frivilous letter or the 30 day response. Once again sent them another CMRRR dispute letter stating they were violating the FCRA due to willful non-compliance of the FCRA, it has again been 30 days with no response.

My question is do I have a true violation of the FCRA? If so, how would I go about filing suit against AMX for the violations? Not sure exactly who I would list as the registered agent to serve against the AMX corporation. The account is well out of the SOL. Any help/suggestions would be greatly appreciated.

I would have to double check, because it's been a while, but I believe the OC isn't required to validate except under the same circumstances as a CA. I could be mistaken, if I am, i apologize. if the SOL has already run, then ur 30 day window would be long gone.

I don't know as much and hopefully someone else with greater knowledge can chip in, but have you tried filing a complaint with the local BBB in the city where you sent the dispute? Also try filing a similiar complaint with your AG's office as well as their's. From what I've read that can sometimes have a good impact on getting something done.
