I think (123) I managed to get a Judgement removed from my EX CR, however, I am having trouble getting the creditors or CRAs to remove the negative info that is being reported on my CR. CRAs are reporting items that was listed in BK as (Transferred closed, Account charged off, or DC thru BK Ch7/Account charged off, etc. Is it possible to get just the DC thru BK Ch7 on the CR and no other status about the accounts. Methuss Posted July 26, 2006 Report Share Posted July 26, 2006 Yes. there is some leverage with the FTC that can be used. According to the FTC, it is *not* accurate reporting for a company to list an item as charged off after it has been discharged through bankruptcy. Because the Bk essentially eliminated the debt there is nothing to charge off.If the item was charged off before the BK, it may be listed as charged off until the court discharges the debt. Then once the item is discharged it is supposed to be updated to "included in bankruptcy."Anything else is deceptive and/or untrue reporting. Don't send them your bk papers and don't let them list is in your BK unless it's absolutely your last resort. Eventually your records will get yanked from their computers and you files will end up in a warehouse somewhere. jq26 Posted July 31, 2006 Report Share Posted July 31, 2006 Related question- AmEx charged off my account after 180 days non-payment. Six months later, the debt was discharged as part of BK7. Eighteen months later, after multiple disputes w/ CRAs and letters directly to AmEx (all certified letters), they continue to report me as "Charge off / Collection". They are the only ones that continue to do this. Are you saying that they must report as IIB? AmEx has sent me two letters telling me that they feel they are reporting this correctly. think123 Posted July 31, 2006 Author Report Share Posted July 31, 2006 Gold Key Credit Inc. is reporting collection 07/2006; assigned 9/2001 also showing $753.00 status as of 7/2006 in Bankruptcy OC is reporting positive.........This should have been a question instead of sounding like a statement. Gold Key Credit Inc is reporting this negative after the BK in 2003. The OC is no longer reporting anything accept IIB. How or What actions to take to get this removed from my collections and just leave the correct reporting on my CRs, which is IIB.
