"To Late to Vacate A Judgement"

Recommended Posts

My sister paid of a judgement in August 2004. We live in California and after reviewing these sites I was wondering if it is not to late to vacate this judgment. If the creditor agrees to vacate it could it also be revoved from her credit reports. Thanks for your help.

If the judgment is DEFECTIVE as a matter of law in some way, or was generated using fraud, it may be attacked as defective and VOIDED. Voiding a judgment is different than re-opening the case to get it vacated. But if there is any real defect in it, that would be the way to go, there is NO time limit on VOIDing a judgment that is infact VOID.

You would have to read up on how to do it, but Ive read here and elsewhere it is possible and the only chance after the timelimit for vacating has passed.

I've also read that the creditor can file certain paperwork and remove the judgment, but I don't know what the paperwork or the procedure is called, and I've never read about anyone having this happen. Unless there was something wrong with the judgment, like previous poster said, they're very hard to remove once paid. By paying, your sister basically admitted that it was correct.
