hawkfan Posted August 1, 2006 Report Share Posted August 1, 2006 A OC has said i have made payments to them for my car that was repoed back in 1997 the truth is I haven't made any payments after the repoe or 2 months prior to the repoe, would they have to have proof that I did make peyments on this account, check-mo-etc? What are you trying to accomplish?There isn't really much you can do to require them to prove anything unless the matter goes to court; then, at least in theory, their assertions do need to be substantiated. hawkfan Posted August 2, 2006 Author Report Share Posted August 2, 2006 Actually it isn't a collection company that did it,it is the finace company who did. I contacted a local lawyer here through myfaircredit.com and he sent email back to me called him today and said that shouldn't be on report and can't believe the finace company is doing this. He said to bring my info tomorrow to him, all I am looking for is to get this off my report and if he thinks more then so be it. Least this is free help unless we bring suit. Robert Nashville/Savannah Posted August 2, 2006 Report Share Posted August 2, 2006 Let’s not overact everyone…If it’s the finance company who is indicating “payments” were made after the repossession then it may well be a simple error (sometimes errors happen just because they happen and not out of malicious intent).It might also be that what the OP is calling a “payment” is one or more account adjustments and not actual payments…it could be a re-credit of interest changes or nay number of routine/normal adjustments.At any rate, what is needed here is a complete account reconciliation showing all transactions on the account (including dates and descriptions)…that’s the only way the OP can get to the bottom of it.
