cathy187
This morning out of the blue Evergreen professional Recovery Agency phone me. I've never heard of them until today. They informed me that I owe a company called Service Merchandize $302.10 for a membership that I joined in 2004. that they had info commericals on tv and that is the way I joined them. Its a place that helps you start a home business which I have never even thought of doing. They are claiming that I joined this place and I was to get a "kit" that shows me how to start this home business but they never sent it because I didn't pay for it but I still owe them $302.10. I have never even heard of this company they have never contacted me about oweing money and I did not join any thing like that. The Evergreen Agency will not verify the account for me when I ask them to please verify this debt they told me that it was already verified because they had my social sercuity number and that means its verified. They are a part of Genesis collection agency. What do I do now? I"ve ask them to verify the debt and they won't who do I turn to now?
hinky
Well, first off they're full of crap. Just because they think they don't have to verify it or validate it doesn't mean that they don't. Read this: http://www.creditinfocenter.com/rebuild/debt_validation.shtmlWrite down everything that happened today, because this sounds like their initial contact to you. What state do you live in? Durr, I'm still not used to the new board. Texas is a great state for consumers. Edit: Do you know anything more about this CA? Where they are located, etc? divemedic
Also, if they never sent the kit because you didn't pay for it, then how do you owe the money?
cathy187
About two months ago out of the blue Evergreen professional Recovery Agency phone me. I've never heard of them until that day They informed me that I owe a company called Service Merchandize $302.10 for a membership that I joined in 2004. that they had info commericals on tv and that is the way I joined them. I contacted the credit agency and a letter asking for validation. I never heard back from them and it has been way over 30 days. So I thought everything was OK. Then yesterday I get a letter from a different collection agency name is Revenue Security Services and they are in TX they have filled a judgement against me. No warning at all and they state that it happened in 2001. A few days before I recieved their letter I just happen to look at my credit report and sure enough there is a judgement listed with equ credit bureau but not the other two and I have already disputed it. I've sent Revenue Security Services the same letter I sent Evergreen to validation this money I'm suppose to owe. I guess Evergreen couldn't validated it so the company claiming I owe them just found another collection agency to try. Can they do that? Can they also put on my credit report a judgement that I have never heard of and I know never happened? Please someone tell me what to do I am not paying a company I have never heard of over $300 for something I never recieved or ordered. Thanks, Cathy

divemedic
If they have a judgement, that means that they took you to court and got a default against you. Find out where the judgement was won, and pull the paperwork. You say they won a judgement in 2001?
nascar
You say they won a judgement in 2001?Is this the same alleged debt you supposedly incurred in 2004?
jasen
I was going to suggest going down to the local PD and filling out an affidavit of identity theft, since it is NOT your account. But I don't suppose that will help the judgement at all, if there is one. I'd still get the affidavit though. You need to call the courthouse of your current county, and any county you lived in at the alleged time of this judgement and see if it really exists. If so, it sounds like you were never served, and you may be able to get the judgement vacated because of improper service. And the dates do seem all wonky. Are we missing something here? direred
That's what I thought -- I wasn't sure about the year since I moved to an area without them in 1998.
