Nursetony Posted August 10, 2006 Report Share Posted August 10, 2006 Ok, I have this Collection Agency that doesn't know when to quit, I have sent them a cease and desist letter, Certified mail, I have the return reciept. I was just informed through 'true credit' that I had a something pop up on one of my CR's. This stuipd collection agency has reported me to the CR's as a collection. mikey Posted August 10, 2006 Report Share Posted August 10, 2006 so what is it exactly that they did that makes you need an attorney. you sent a C&D letter which to some here, means nothing....you didnt say you sent a validation letter and this company is just doing what any other would do. collection agencies are in the business to report collection, are they not? they reported a debt. Then I sent them a C&D letter, again via Certified mail (yes I have both returned reciepts.) Under the FDCPA they are they can make one final contact. If there was no contact, there would be no violation. § 805. Communication in connection with debt collection [15 USC 1692c]© CEASING COMMUNICATION. If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except -- (1) to advise the consumer that the debt collector's further efforts are being terminated; (2) to notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor; or (3) where applicable, to notify the consumer that the debt collector or creditor intends to invoke a specified remedy. mikey Posted August 10, 2006 Report Share Posted August 10, 2006 no, i get plenty of java.....but i failed to see you mention that you sent a validation letter in your ranting. a C&D letter doesn't stop them from reporting on your cr....that was all you mentioned before. my attitude was not bad dive. i just wanting clarification why he was in need of an attorney. nothing was mentioned that was out of line. geez, some people look for trouble by reading too much in between the lines.
