sacs152001
Ok I did the debt validation process via regulaer mail. Not sure if that played into the respons. Anyways I sent a letter to CITI asking them to verify the debt. This account was settled almost two years ago so I don't owe anything on it. Here is what CITI said.We have reviewed your recent letter concerning your claim that the bank has an obligation under federal law to validate the debt within 30 days of your letter. We respectfully disagree with your interpretation of the applicable laws and thus decline to respond further to your inquiry. We have reported to the consumer reporting agencies that the above account is in dispute.Anyone know what is my next step? what should i do? sevastras
Unfortunately they are correct. They are not legally obligated to respond to your letter. They are the original creditor and not a collector.
divemedic
If the account is paid, can you prove it?Is it reporting with a balance, or does the TL say it was settled?Did you dispute through the CRA?
sacs152001
Well the account is paid. It shows up on my credit report with a zero balance and settled. CRA stands for Credit Reporting Agencies right? i have disputed with them. I guess since they are the original creditor I would have to attack this differently. Anybody have any advice? divemedic
Actually, as long as the TL is correct as reported, that is all you can do. Looks like you will be stuck with this negative TL.To all of you who think we should just pay or settle, this consumer paid and is stuck with a negative TL. IF they had fought instead- the TL would be gone.
sacs152001
so you're saying had i not settled i would have been able to remove? Is it possible to remove this? Anyone ever had a paid settlement removed?
divemedic
Once a settlement is paid, it is MUCH harder to get a delete. When you pay, you give up your biggest bargaining chip (your money)
curly
I live in NC looked up SOL for my state. Under Open account: 3 years, NOTE: Each payment renews the SOL on all items purchased within the 3 years prior that payment. If no payment is made, the SOL runs from date of each individual charge. So I guess it is saying that if I made A payment that would start the SOL over again another 3 years till expires? Also when it says if no payment is made the SOL runs from date of each individual charge. Well the acct I'm thinking of has not had charges on it for years. So I guess it is saying that if I charged something back in 2000 SOL Started on that charge in 2000.Am I correct?
