negotiating a settlement

Recommended Posts

I would like to negotiate a settlement. However, I see WI is a state that a creditor can retain their rights to sue me by writing "under protest or without prejudice" with his endorsement. What would be the advantaes of getting something in writing (assuming I can) for a settlement if we settle, I send them a check and they retain their rights. Then I am paying them off fully anyway. Any thoughts?:x

I think what BE is asking is where did you see this law stating that the creditor can retain their rights to sue you.

I wrote up a settlement letter and worded it so it basically said "by accepting this settlement, its dismissed with predjudice and you can't come after me or resell the debt or blah blah blah"

They signed and I sent a check.
