Is there a lawyer that can help!!!!!

Recommended Posts

Here is a weird question.

We are in a lawsuit that involves us as the Plaintiffs. The summons and complaint have been served to the defendants we listed. The defendants are now trying to get another person named as a defendant in the suit. We had the right to name the person under the lawsuit, however, he did do things that could be considered obstruction of Justice (maybe) but didn’t break the law that we are suing the defendants for. How can they do that if we didn’t name this person?

x:-)

It's known as impleading a third party, and yes it's done. Generally it requires that the newly named defendant is liable to the other defendant, not you, for damages occurring out of the same set of circumstances. Check your rules of civil procedure.
