Minor victory in court

So today was my return date. Things are done differently in VA. Your "answer" is your appearance. So I appeared and stood on my motion to quash.

The judge seemed pretty pissed off that I wasn't served, and forced the attorney to give me more time, and issue and alias summons (serve me all over again).

Just figured I'd share.

This is what I dont get.. I hate this process..

now you get to come back because they didnt do their job.. frankly they should dismiss it (I know they wont)

I get annoyed, when my friend went to court she went four times and finally asked for stuff every time.. cut the lawyer for the JDB all kinds of leeway and kept making her come back..

I hope your judge sides with you.... please keep us posted.. I thought about you today

I just looked at the judge and said so...that's my relief?????

Doesn't bother me too much, I figured the judge wouldn't even listen at all, but he changed his tone when I started spitting out State Statutues. Maybe I should have even spit out some case law. Maybe my fault for not asking them to dismiss, but I am still learning.

Thank you for your thoughts. I will try to wack them on SMJ, they won't validate, and probably won't substantiate proper standing on my "private" communications with them. I want to keep the black robe out of it.

Get me up to speed here... how did you know about this, and how was the service improper?

Sure, I received a home equity loan offer in the mail offering me a loan to pay debt I was being sued for in General District Court.

I checked the county docket, and my name was up there.

I moved a few months ago, so the creditors had the wrong address and allegedly had the sherrif post a notice on the front door of my old address.
