Verizon charge-off update

Well, I disputed with the CRA's and all came back verified from Verizon. I requested debt validation (with complete payment history and stated laws etc) from Verizon and re-disputed as soon as the green card came back last week. Those investigations are still pending.

I received this letter from Verizon today:

DEAR CUSTOMER,

THIS DEBT VALIDATES THE DEBT YOU OWE TO VERIZON WIRELESS. OUR RECORDS SHOW THAT YOU ARE RESPONSIBLE FOR VERIZON WIRELESS ACCOUNT NO. 0010055667XXXX. THIS WAS OPENED ON 06/14/02 AND WAS WRITTEN OFF ON 04/25/05. CURRENTLY, THE OUTSTANDING BALANCE FOR THIS ACCOUNT IS $0.00. THIS BALANCE INCLUDES CHARGES FOR CELLULAR TELEPHONE SERVICES AND TAXES.

ALTHOUGH VERIZON WIRELESS IS NOT OBLIGATED TO PROVIDE COPIES OF STATEMENTS FOR THIS ACCOUNT, WE WILL, UPON REQUEST, PROVIDE THEM TO YOU WITHIN A REASONABLE TIME FRAME.

VERIZON WIRELESS FINANCIAL SERVICES

When they verified on the 24th of this month, they changed the balance from $0 back to $31 but are still reporting it as paid. I have copies of reports showing them re-aging the account as well. They have now changed it to show reporting for every month on current reports. I'm not sure where to go from here. Should I wait till they verify with the CRA's again... do I have to wait until they provide payment history? Or should I send them an ITS letter with a 15 day limit etc?

I'm not sure about Cali...

I know they don't have to respond ina given amount of time... I thought they had to provide me with the same information they're reporting to the CRA's if they verify with them (which they have)

As far as filing suit.. I'm not worried about getting paid... I just want the delete! I have everything I need I think... several violations:

re-aging

Not noting the dispute in the tagline or notes

Incorrect balance now

I just wasn't sure if I should immediately file a suit... or if I should send them a more threatening ITS letter if it is not deleted.

One question... to file a suit against them, can I just go to my county court? Or do I need to start somewhere else? I'm extremely new to this!

I received this alert from Equifax ScoreWatch a couple of days ago. Verizon updated and not only left out the dispute notation, but also changed the balance from $0 to $31.

I am sending them an ITS letter tomorrow CMRRR, listing violations of FCRA 623 for innacruate reporting and 605 © for the re-aging. I'm not sure what the section is for not noting the dispute? I'm looking it up right now but if anyone wants to throw it in, I'd appreciate it! :)

Jess1120, sorry to steal your thread, but I have a very similar situation. I'm in IL, and Verizon Wireless is reporting a charged off account for $858. I disputed with the big 3, and it came back verified. I sent a letter to Verizon stating I had no recollection of the account, and requesting documentation verifying the debt, including at the very least a payment history.

They sent back a similar form letter Jess1120 received,

THIS LETTER VALIDATES THE DEBT YOU OWE TO VERIZON WIRELESS. OUR RECORDS SHOW THAT YOU UNCKBOBBY ARE RESPONSIBLE FOR VERIZON WIRELESS ACCOUNT NO. XXXXXXXXX. THIS WAS OPENED ON 09/08/04 AND CLOSED/DISCONNECTED ON 06/23/05. WHILE ACTIVE, VERIZON WIRELESS PROVIDED CELLULAR TELEPHONE SERVICES TO THE ACCOUNT THROUGH TELEPHONE NUMBER (XXX) XXX - XXXX. CURRENTLY, THE OUTSTANDING BALANCE FOR THIS ACCOUNT IS $1,046.80. THIS BALANCE INCLUDES CHARGES FOR CELLULAR TELEPHONE SERVICES, CANCELLATION FEES, COLLECTION AGENCY FEES, AND TAXES.

WITH THE INFORMATION WE CURRENTLY HAVE IN OUR POSESSION, THERE APPEARS TO BE NO VALID BASIS FOR YOU TO DISPUTE YOUR OBLIGATION TO PAY THE EXISTING BALANCE ON THIS ACCOUNT. IF YOU WOULD LIKE FOR US TO FURTHER INVESTIGATE YOUR CLAIM THAT YOU SHOULD NOT BE RESPONSIBLE FOR THIS ACCOUNT, WE ASK THAT YOU SUBMIT IN WRITING, THE FOLLOWING ITEMS... LIST OF SPECIFIC DISPUTED ITEMS, BASIS OF DISPUTE FOR EACH ITEM, AND SUPPORTING DOCUMENTATION ETC...

ANY SUBMISSIONS SHOULD BE SENT TO THE VERIZON WIRELESS RECOVERY DEPARTMENT, SINCERELY SCROOGE MCDUCK.

Sorry for all caps w/ the letter, didn’t even realize until I was done.

My question is, is this sufficient information to verify the debt? [if they have the documentation, such as the contract, bills, etc. why not just send copies of it? How much is for cell services, cancellation fees, and taxes... That’s information they need to provide, correct?

In my case, they did have copies of all payment history (dated back to the account opening in 2002), so I'm pretty sure they keep fairly good records for awhile.

I would request the payment history from them and make sure it is correct. Also, check for any mistakes in the credit reporting. I have a court date with them this Friday and so farm they have not backed down and will not settle (and I owe them nothing). All I asked for was a deletion in exchange for case dismissal. So it's not likely they'll remove the CO for you unless you can prove you paid it before... or can prove some form of FCRA violation.
