CaptCBM
Some of you may remember I had an MBNA Account that charged off and went to W&A for collection. Today I log into my BOA online info and found that my BOA Credit Card which had a zero balance and only $400 limit now has the full balance from my MBNA card. I'm very freaked out because I still cannot pay the card but we have bank accounts at BOA, joint account with my husband but it's actually all his money-I'm unemployed, and now wonder if they can randomly withdraw to pay the card. Also this new balance will bring me over the limit and the interest rate on this card is ridiculous, this crazy amount is going to keep growing- I will literaly never be out of this hole. I'm guessing I have no course of action however any recommendations would be appreciated. Thanks in advance.
CaptCBM
I just looked again and actually they did not tack it on to my existing account they opened a new separate account with the amount they charged off. I'm not sure of the details because the BOA site says the credit card info is being updated so is not currently available??
VonAngel (aka EarthAngel)
I had a similar situation earlier this week. My old (CO) BOA CC was suddenly listed in my online banking portfolio. I was frantic!! I, too, was afraid that they were going to debit my accounts (I have both checking & savings thru them) to pay down the CC. So, I called them up & spoke to several pple actually. I was told that BOA had officially merged w/ MBNA & that online banking was kinda screwy. They assured me that BOA would not & does not seize funds from your accounts to pay on a CO CC (not unless they got a judgment of course). A guy in the CC dept also said that the old card would be removed from my profile in a few days and not to worry. It had been referred to collection; so BOA no longer has any dealings w/ that account. I was still nervous, so I continued to check my account regularly. This morning, lo' & behold, the CC is now gone. I'm still keeping an eye out though just to make sure.
jasen
I wouldn't trust that at all. Too many times have people come on here and told us that their bank just cleaned out a checkings account to pay for a delinquent CC.I would certainly watch it like a hawk. DucknCover
I would be opening a new checking account with a different bank in a hurry.
Methuss
A bank is not allowed to seize funds or pile on debt to another account unless you sign a cross-collateralization agreement with them. Such an agreement must be implicit and cannot be part of a credit card terms of use change (aka a contract of adherance).
IHateCAs
Well MBNA is BoA now. Makes sense to me. It's still the same debt and apparently MBNA didn't sell it off, just sent it for 3rd party collections. It's great to still be working with the OC. CaptCBM
Thanks for all the replies, Earth Angel & Methuss your responses were especially helpful. I am going to call the new 800 number BOA is providing on their website. I am hoping that maybe I can still deal with them on a settlement or repayment terms that I can manage, something I could not seem to acomplish with MBNA. LadynRed
I had a similar freak-out as EarthAngel. I had 3 MBNA accounts (I really only had TWO, where the 3rd came from I think is a mistake MBNA made a few years ago) that were all IIB .. charged off in 2002. The other day I saw these 3 'credit cards' list on my on-line banking at BofA. I was rather ticked, even though they all say 0 balance, 0 due, close 2002, just them being there at all was enough to make me nervous. I didn't call Customer Service that day, I got too busy, but I'm glad to hear that this crap will come off my on-line banking !!I just checked my on-line banking.. these 3 cards are still there !! Maybe I should call them.....
CameronLocale
I actually changed away from BOA as soon as I heard of the merger on principle.I won't use Fed Ex on principle either, as they deliver certified mail for collection agencies.I don't understand why they do it, if I was in the delivery business, I wouldn't want to alienate people. CaptCBM
I went back today and the MBNA account has vanished. I am however going to pursue trying to settle with BoA maybe I can have better luck than with MBNA?
