rchakrab
HiI had a Citibank credit card that was charged off in 2004. Citibank sold the debt to UniFUND which in turn has sold it to A & A North American Financial. A & A North American Financial has now hired a law firm in Michigan called G Reynolds Sims and Associates. I got a letter from this law firm in August to which I sent in a DV letter. After almost 2 months I got a letter from them which contained the following documents1. A computer printout showing the total amount owed2. A notarized affidavit that the Debt has been transferred to A & A North American Financial , singed by a representative from UNIFUND3. Copies of the original Credit card statements with my name and address.I am not sure about how to proceed at this point of time. Is this sufficient validation?Should I send in another letter requesting the following documents1. Original Cardmember agreement that I signed with CitiBank2. Copy of the Agreement showing that the Debt was transferred to UNIFUND from CitiBANK.I currently live in NJ. I would appreciate any advise you can give me.RegrardsRchakrab
kevin3344
It sounds like copies of the original documents is sufficient validation...I might try a different approach here. Let me give you an example: I actually had two CAs provide validation in my case...they contacted the OC and they sent original copies. Problem was, for one the CA wasn't licensed to collect in my state, and for the other I included the BBB on a post-validation letter and they decided to delete. In both cases, however, the debts were 5-6 years old. So try something different and see if that works.________18TEEN Edited September 9, 2011 by kevin3344
rchakrab
KevinThanks for your reply. I live in NJ and I believe licensing is not required. Can you tell me a little bit more about the kind of letter you send to the BBB.Appreciate your help.
kevin3344
Sure, I basically told them the debt was at -or- over SOL and they couldn't pursue me for the debt. Not sure if this will work in your case, since 2004 is relatively recent. Mine was in the 2000-2001 time frame, so I knew if the SOL wasn't up it would be up soon. The debt. was incurred in NY where the SOL is 6 years.Depending on the amount, you might try to settle this if you are not close to the SOL being up on the debt. It never hurts to involve the BBB, though, and this might give you more time while they do their investigation.________Depakote Sickness Edited September 9, 2011 by kevin3344

You have to use snail mail to get a copy of their licensing status. Dept of Revenue I believe. They'll get back to you in about 4-6 months.
