DellMatic Posted November 6, 2006 Report Share Posted November 6, 2006 Hi guys, thanks to all you guys for really helping me out for the last 8 months, I have learned alot from you guys now like Angel told me once to build credit I have to have accounts open in good standing, now I am in the process of getting my first Secured card with BoA, now I am trying to delete a couple of inquiries, I call the TU and lady told me that I have to write the CA now my questions are these1-how do you get inquiries deleted from the CR?2-is it true that I have to write these companies that are not even on my CR but their inquiries still there?3-will this simple letter do it??Re: Unauthorized Credit InquiryDear Company,I recently received a copy of my Experian credit report. The credit report showed a credit inquiry by your company that I do not recall authorizing. I understand that you shouldn't be allowed to put an inquiry on my file unless I have authorized it. Please have this inquiry removed from my credit files because it is making it very difficult for me to acquire credit.I have sent this letter certified mail because I need your prompt response to this issue. direred Posted November 6, 2006 Report Share Posted November 6, 2006 It is my opinion (and I am still mucking through case law and have found none yet one way or the other) that hard inquiries for collections are not permitted by the FCRA for two reasons:1) FCRA 604©(3) [§ 1681b] says it shouldn't be for something not initiated by the consumer, and therefore the CRA cannot dislclose it to third parties.2) There is NO WAY for the CRA to know if the inquiry is for something outside the 7-year reporting period, therefore it shouldn't be reported.So, I'd lobby to get them re-coded as soft. I sued a company who refused, but silly me, I didn't read carefully enough and should have sued the CRA as well.Is Presidio an OC? If so, they don't need to DV. It's due to fall off in five months, and it may just take you that long of slugging back and forth with them to get it removed.I have a letter that I've used in the past to get inquiries removed with 50% success on my drive somewhere, I'll dig it up if I can find it.I haven't been around for a while due to my old PC being fried, etc....so hello to all my old friends!! kevin3344 Posted November 20, 2006 Report Share Posted November 20, 2006 (edited) For the judgement, I would look at getting any old addresses deleted first, then dispute.
