ECLIPSE
I live in FL and I recieved a summons today by the sherrif's office. I have a credit card debt with Citibank of about $13,000. It says, summons: personal service on a natural person. It also says, a lawsuit has been filed against me and I have 20 days to file a written response. I don't see a court date on the paperwork. I was just trying to find out what this means and what may be in store for me? Any help would be greatly appreciated.
breathing_easier
Go to the 'Is There a Lawyer in the House?' forum and read the two sticky threads at the top entitled 'If You're Suing or Being Sued (Parts I and II)'. Then answer the questionnaire posted in the thread, post it, and we will try to help. Check with the court listed on the Summons to make certain it has actually been filed with the court. If it has, the court will set a date for your hearing and notify you of such.
Recovering Attorney
you have to answer the sumons and complaint. If you wait for the court to contact you you will find yourself with a default judgment
ECLIPSE
Thanks for the replies. I have 20 days to reply. Do I reply to the court? What am I supposed to say in the reply? I don't deny this debt. I owe them the money, I just don't have any extra cash to pay a lump sum. I could make payments, but only about $75 monthly. Thanks in advance for any help.
