Ed
Can anyone tell me what it means when my first mortgage is not recorded at the county courthouse I reside in? Only my second mortgage is recorded. Are the mortgage papers I signed considered as a lien?Thank you.
admin
It means the first mortgagee was sloppy when doing the transaction. All they have to do, though is show a signed deed and you are obligated, so I wouldn't get your hopes up. You can record a deed/lien at any time. LadynRed
An unperfected lien would be a HUGE problem if you were to file bankruptcy though. All the Trustee would see is 100% equity because the mortgage lien is non-existent.
