PolarBearnCO
If the debt is mine, the amount is correct, etc, etc... is there some point to a DV or should I just pay it?I understand the possibility they cannot verify, so the TL could be deleted and I have no interest in sueing FDCPA violations. So, if I can get them to settle in writing and delete upon payment, is there any reason to DV? DV costs money. I know the debts are good and I know the debt amount is corrent. I also know from talking to the OC that this CA is the one assigned to collect. Some of mine go from 6years - 1 year. I guess the older the debt the harder to prove. I am still learning. Sorry not much help to you. If it were me though and I could get them to agree in writing to PFD I think I would do that.
Lisa0825
Unless I am missing something, all a DV "costs" is the certified mail and return receipt fee, which is about $4 or so, right? If the CA can't validate, how sure can you be that it is accurate? Would you really want to pay someone who can't give you accurate records on your debt? Especially since they generally tack on all kinds of fees and penalties. If I am going to pay someone on a debt that is MINE, I still expect them to give me proper authentication of it. If you'd rather save $4 and "trust them," go for it.

I have 10 of them. $40 is a nice chunk of change to DV debts I know to be mine, debts I verbally DVed with the OC who said "talk to the CA." I doubt I'll be paying any fees. I'm rather stubborn and am gifted in the art of negotiation. It's my way or the highway. Easy rule.

I'd definitely DV first. Even if you only "win" on one, you'd saved more than enough to cover the postal fees.
PolarBearnCO
Doesn't a "win" with a DV only delete it from the credit reports? I think they can still sue to get their money, up to SOL. SOL in Wyoming was 10 freakin' years!!

divemedic
If they do not have enough evidence to DV, they don't have enough to sue.CA's are notoriously poor record keepers. Most cannot validate.
