Bank Issue-Need advice please

okay no response so I am trying again..

My bank account was garnished by the state.. should not have happened.. the Rev officer is faxing a form to them to release it..she says some banks are easier to deal with then others. she faxed it after hours.. since it didnt come out until 7 pm tonight.. she was nice enough to return my call as soon as I called her , which was after 7.

I need to know.. is my account frozen/ does that mean incoming checks are not even looked at.. right now I am at zero balance.. they cleaned it out.. and will they refund what they took.. and how long does it take.. help gang.. I cant believe this.. the Rev officer was very nice.. since I had made all my payments on time (I have been paying this for two years and have only two payments left) someone just went in and cleaned it out.. NO warning and they got about half of what I owe... and of course I have a ton of outstanding checks right now as well..... this is scaring the crap out of me...but I still owe the money.. so I wonder what happens now....any help would be great.. what can I expect when I talk to the bank tomorrow.. and how do I go about getting the funds back since I made all the payments

Do banks cancel your account for this.. ??

I'd be on the phone with your bank ASAP in the morning.

I dont have any experience with something like this but, I would think any outstanding checks that come in would be returned NSF and your bank's NSF fees would apply. They dont care WHY you have a zero balance - only that you do. And unfortunately, I doubt the Dept of Rev would reimburse you for those fees even if it is their mistake. I doubt your account is "frozen" - it just has a zero balance. And I seriously doubt, you'll get that money back as fast as they took it.

Call your bank. Perhaps they have an after hours number. I know mine does but, I would prefer to speak to the manager at the branch I deal with locally

Thanks.. I have a source in the main office.. my local manager is a 23 year old airhead and everytime I go in there she screws up something on my accounts which is why I no longer deal with her.. I really dont know how she ends up there.. but they have a high turnover rate she may not even be there anymore. they dont have after hours .. they are only there until 8 pm

I will be on the phone with them in the AM I talked to the Rev officer and she said she was going to fax them the release and not to take out anymore funds.. she said she would follow up by phone but late tomorrow after she is out of a meeting..

I did notice I got hit with 144.00 in fees tonight. for items I had pending..which they did pay.. thank goodness..

I am so pissed this happened.. I did everything I was supposed to.. I started this with a 11,000.00 balance.. I am down to a little under 1200.00 and NOW they clean out the account. I never missed a payment.. and this "it shouldnt have happened' isn't helping a bit..

I have never been this road before... the bank does not care its not their fault.. but the fees are going to pile until I get paid on the 30th.. what a huge hole.. NO one should be allowed to touch a bank account.. what a mess

The reason I think its frozen is because on all my accounts I have a transfer funds option.. my savings (which had little but they got it too).. still has the transfer option even though there is no $$ in it.. however the transfer option for the checking is gone... which made me ask can they or do they close an account for this..

I also have an amount in overdraft protection.. I notice that option is gone as well.. I dont keep alot in my accounts so I guess thats a blessing but still.. this is really stressful

Well I learned a few things that might help others.. I was blessed.. .. the Rev officer was terrific.. sent the fax last night.. as of 8 am when I called the bank the money and fees had all been refunded (I have a great bank).. since the Rev officer told me many banks take a while and most dont return fees.. mine said "it wasn't your fault"

They also held the checks I had last night so I would not incur fees..and will post them tonight. (normally they would go back to the person I wrote them too)

The only fees I had were ones from automatic payments.. (as I said.. were refunded).. I love this bank.. they even let you make an ATM deposit up until 8pm and it still counts for that day... I was very happy they did this so fast

She did tell me however that it is automatic (federal law) when they come in for taxes or in some cases garnishment the account is frozen for up to 15 days.. even if your garnishment is for 500.00 and you have 5000.00 in the account all checks or payments are returned and the account is unusable except for deposits.. but they said they would not cancel an account over it... so even if you have more then enough it makes no difference... I was not aware of that... the only way it can be lifted is if the party going into the account sends the release..

Thank God this turned out simple and I am out nothing... I am so thankful the rev officer called me back at home last night after hours.. she is a gem.. I owe her big... and the bank stayed on top of it.. as you know in the real world.. it hardly ever works that way..

I am very happy for you Caroline. That must have been frightening. I am glad it all worked out. I am very impressed with the service most times people are quick to enforce the negative but damn try to get them to correct a mistake.

I totally agree.. I kept thinking I will never see that money again or of I do it will be forever.. Heck even Mastercard takes forever to credit a refund but will charge it before you put your wallet back in your purse.

I knew they would lift the freeze since the Rev officer requested but how usable my account was I didnt know and since its the end of the month all the fun payments.. mortgage, Utilities.. etc had been mailed and written I was looking at an onslaught of bad rubber.. the timing couldn't have been worse. but then again I couldn't have asked for better or faster results.. I am so pleased the bank jumped on it.. didnt see that coming... and of course my angel Rev officer.. who was watching Charlie Brown Christmas with her son when she called me.. lets face it.. she didnt have too... your right my Angels were out there.. this was eye opening to say the least.

I'm so glad to hear that you had such a positive response.

That is frankly my worst nightmare!!!!!!!!

believe me.. mine too. when I was having huge issues the fear kept me up nights.. now things are starting to get on the right track and in this case I did everything I was supposed to.. I was on a consistant payment plan and there was no reason for it to happen.. the rev officer said someone in Raleigh (our state capitol) got a little trigger happy.. he did it with quite a few of us on payment plans.. she thinks he was a new guy trying to impress.. lucky me
