I'm being sued by an OC.

It's actually written as:

MBNA America Bank NA

c/o Wolpoff and Abramson LLP

Attorneys in the practice of debt collection

It went to arbitration in April of 04.

I was told by credit repair person to ignore it.

So now they want my local courts to confirm arbitration award. I was served in earlier this year and have a court date on Dec 15.

I have sent the courts a response basically saying that I deny all charges.

I also have another suit against me from a collection agency, and they haven't responded to me with a court date.

I had a 785 score, before my husband started doing drugs and I lost my house, my car, my business and also all of the credit cards.

I would prefer not to file BK, but if there's no way to fight this "Arbitration Award" I may have to...any suggestions??

I think if you mentioned the balance, others would be able to help out more.

I owe over 60K in Medical, CC's and a repo, not to mention the forclosure. I've been fighting not to file BK. I've always had good credit. I'd rather repair it slowly then to file BK

I STRONGLY advise to weigh your options before BK. Fighting the case is almost always a better way to go IMO. If it is a huge debt, seek legal advise. Otherwise, read through the threads here, you can get good answers fairly easily, and a knowledgable person will usually always post an answer to your questions.. Regardless, welcome.

Secondly, I am currently in dealings with W&A, they are suing me for a alleged discover card. They are pretty nasty. Your court date is getting very close. Check to see if your city has a pro bono or legal aid program. They are giving me free pro se counsel ... Someone should post some more knowledgable help soon. Be on the lookout

I'd go BK. Just my opinion. I would just get it over with and build yourself back up. Again just my opinion having gone BK already and being able to remove it via technicality.

With that sort of debt, I think it would be easier for you to get new credit cards etc if needed post BK.

No way anyone is giving me a CC anytime soon and for yrs to come.

Think about it, look at all my posts just trying to defend over a $2400 debt. Do you want this hassle? It's up to you.
