what can i do?

Recommended Posts

heres the situation

assest acceptance llc. sent me a bill for $4,600.00, i then sent a DV letter, they returned propper validation but everything that they sent me was way after the SOL for south dakota, so i sent a letter asking for proof that the account was still in the SOL, i have not heard anything back, this process took about a month and a half and all letters i sent was certified. ok to the present, i recieved a copy of my credit report and assest acceptance has a negative line on there which wasn't there 2 months ago saying that the balance is $347.00 and that the line will be removed next month. my questions are

1. is this against the law since i have not recieved anything stating that the bill is with in the SOL for my state?

2. if i go to court over this in the future can i use my credit report for validation that i only owe them the 347.00 instead of the 4,600.00?

3. what are they trying to accomplish by putting in that negative line for only a couple of month?

4. can they try for a judgment before they give me proof that the bill is with in the SOL?

any help will be appreciated

No

No

It's their way of inspiring payment

They would have to sue you to get a judgment. Your defense is it's beyond SOL for suit.
